2022 Northern Rivers Flooding Proposed Class Action FAQs

Gerard Malouf and Partners (GMP-Law) are proud to be investigating the impact of the construction concerning the M1 Pacific Highway between Grafton and Ballina, and it's relationship to the extraordinary flood damage occasioned to the Northern Rivers community in February-March 2022. Thousands of people in the community have expressed the view that the M1 Motorway acted as a levee bank. Instead of water flowing east towards the coast, it was captured and channeled along parts of the M1 Motorway, stretching over 60km long. It is alleged that the roadway was constructed in such a way as to aggravate pre-existing flood levels. 

Is there any risk in registering?

No, there is no financial risk to you in registering with our law firm.

What will it cost me?

We propose to  bring the class action on a 'No Win-No Fee' basis. This means we will not charge any professional legal fees or out-of-pocket expenses until the matter is successful. Alternatively, if granted, a Group Cost Order lodged in the Victorian Supreme Court will financially protect the plaintiff and class members.

Will I be liable for any of the other side’s costs if the case is unsuccessful?

No, a Class Member is not responsible.

Will I be included in the Northern Rivers Flooding Class Action?

By registering with our firm you will be included in the proposed Class Action if and when it is lodged.

 

If you do not wish to be included, you will have an opportunity to opt out before such date as the Court may specify. Published notice will be given of this date in due course.

(a) provide you with regular updates and advice concerning the progress of the case.

(b) assist you in obtaining such information as may be necessary in connection with the resolution of your individual claim if the case is successful.
